Terms of Service
These terms govern your use of the hosted Cairn service operated by Vela Partners. The open-source Cairn project is licensed separately under its repository license; these terms apply to the hosted service only.
1. Acceptance
By accessing or using Cairn, you agree to these terms. If you use Cairn on behalf of an organization, you represent that you are authorized to bind that organization.
2. The service
Cairn connects to your GitHub repositories to map user flows, generate and run end-to-end tests, track API contracts, run security recon, file issues on failure, and draft fix pull requests. Features may change over time.
3. Accounts & eligibility
You must authenticate via GitHub and keep your account secure. You are responsible for activity under your account. You must be at least 16 and able to form a binding contract.
4. Acceptable use
- Only connect repositories and environments you own or are authorized to test.
- Do not use Cairn to attack, probe, or test systems without authorization.
- Do not attempt to disrupt, reverse-engineer, or abuse the service or its rate limits.
- Do not upload unlawful content or violate others’ rights.
5. Your data & license
You retain all rights to your code and data. You grant us a limited license to access, process, and store your repository and run data solely to provide and improve the service for you, as described in our Privacy Policy. Where we process personal data on your behalf, our Data Processing Agreement applies.
6. AI-generated output
Cairn uses third-party AI models to generate tests, diagnoses, and fix pull requests. This output may be incomplete or incorrect. You are responsible for reviewing any generated test, issue, or pull request before merging or acting on it. Cairn does not merge changes without your action.
7. Third-party services
Cairn relies on third parties (including GitHub and AI model providers). Your use of those services is subject to their terms, and we are not responsible for their availability or actions.
8. Open source & self-hosting
The Cairn source code is made available under the license in its public repository. That license governs your self-hosted use; these terms govern the hosted service we operate.
9. Fees
Some features may require a paid plan. Pricing and payment terms, if any, will be presented before you incur charges.
10. Intellectual property
We and our licensors own the Cairn service, brand, and software, except for the portions made available under an open-source license. These terms grant you no rights to our trademarks.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that tests, diagnoses, or fixes will be accurate or that the service will be uninterrupted or error-free.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELA PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE PRIOR TWELVE MONTHS OR USD $100.
13. Indemnification
You will defend and indemnify us against claims arising from your data, your use of the service, or your violation of these terms.
14. Termination
You may stop using Cairn at any time by uninstalling the GitHub App and deleting your account. We may suspend or terminate access for violation of these terms or to protect the service.
15. Changes
We may update these terms; material changes will be posted here with a new date. Continued use after changes means you accept them.
16. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
